BOOKING TERMS AND CONDITIONS 


Kindly ensure that you thoroughly review the terms and conditions. Should you have any concerns or reservations regarding these terms, we kindly request that you contact us prior to making a booking. By proceeding with a booking, it is understood that you have accepted and agreed to abide by these terms. Please be aware that these terms may be subject to occasional updates, therefore we advise you to refer back to them in the future.


1. DEFINITIONS

1.1 The terms "Customer", "you", and "your" pertain to the individuals who make a reservation and make payment for the Photobooth service.
1.2 The terms "Guest(s)", "Adult(s)", "Person(s)", "Attendees", "Guardian(s)", "Child", and "Children" refer to the individuals who attend the event and utilise the Photobooth.
1.3 The terms "We", "team", and "us" denote The 360 Family (The company) that provides the service.
1.4 The terms "Event" and "Venue" represent the physical location where the service is rendered.
1.5 The terms "Photobooth", "360", "Video booth", "Equipment", and "Item" indicate the equipment owned by The 360 Family.


2. BOOKING & PAYMENTS 

2.1 All bookings must be made through The 360 Family website, www.the360family.co.uk, or via the official The 360 Family Instagram page, the360family_. If you wish to proceed with your quotation or booking, kindly respond to our email.
2.2 Upon confirmation of your booking, a non-refundable deposit of £100 and the signed contract agreement are required to secure your event date. The payment methods specified in the contract must be used. If your event is less than a week away, full payment is mandatory.
2.3 Any deposits made will be deducted from your final balance.
2.4 The remaining balance can be paid in instalments or in full, but must be settled at least 48 hours prior to your event.
2.5 If you prefer to pay in instalments, you will be requested to establish a payment plan during the booking confirmation process.
2.6 Once payment has been made, you will receive a confirmation email which will be sent to the provided email address. Please ensure that you check your inbox for this confirmation. Occasionally, it may be found in your spam or junk folder.
2.7 It is important to review all details at the time of booking to ensure accuracy. If any information is incorrect, please notify us immediately via email at info@the360family.co.uk so that we may assist you.


3. AMENDMENTS/RESCHEDULING YOUR BOOKING 

3.1 If you wish to make changes to the date, time, location, or package of your booking, kindly inform us by sending an email to info@the360family.co.uk. We will make every effort to accommodate your request, although we cannot guarantee it as it depends on our availability.
3.2 When rescheduling, please ensure that the new date falls within 6 months of your original date. Please specify the desired date in your email, and we will check for availability.
3.3 In the event that we are unable to accommodate your request and you decide to cancel your booking, please refer to our cancellation policy outlined in clause 4 below.


4. CANCELLATION POLICY 

4.1 In the event that you decide to cancel your reservation, kindly inform us by sending an email to info@the360family.co.uk.
4.2 Please take a moment to review the following points which outline the refund policy applicable to your cancellation:
4.2.1 If you choose to cancel your booking more than 7 days prior to the scheduled date, please note that your £100 non-refundable deposit will     be forfeited.
4.2.2 If you opt to cancel your booking within 7 days of the scheduled date, you will be eligible for a 65% refund, which will be credited back to     your original payment method. It is important to note that this refund does not include the £100 non-refundable deposit.

5. LOGISTICS 

5.1 The duration of your hire does not include the time needed for setting up and packing down the booth and equipment. You will have the full duration of your hire to use the booth.
5.2 For the set up and pack down process, we kindly request a minimum of 1 hour before and after the booking.
5.3 If you need the booth to be set up earlier than 1 hour before the booking, additional idle hours can be added to your booking.
5.4 In case the booking location is not at ground level and lacks lift access, please inform us at the time of booking or at least 7 days prior to the booking date.
5.5 Within a 1 mile radius of the venue, we require suitable parking arrangements to be available.

 

6. USE OF THE 360 PHOTO BOOTH 

6.1 Our trained attendants will be operating the booth during your event.
6.2 Guests are strictly prohibited from operating the booth at any time.
6.3 The attendants will provide instructions to all guests on how to safely use the booth.
6.4 It is the responsibility of each guest to follow the guidance provided by our trained attendant when using the booth.
6.5 The customer (the person who made the booking) will be held responsible for any damage caused to the booth or other special effects equipment by a guest who fails to comply with the instructions and safety procedures given by The 360 Family attendant. 


7. ACCESS, SPACE & POWER REQUIREMENTS 

7.1 The customer is responsible for ensuring that there is an appropriate and clear space available for the Photobooth at the event or venue.
7.2 Please refer to the requirements below:
 7.2.1 For the inflatable LED booth: The space should measure 5 meters in width, 6.5 meters in length, and 3 meters in height.
 7.2.2 For the Photobooth without the inflatable LED booth: The space should measure 2.5 meters in width, 2.5 meters in length, and 2.5 meters     in height.
7.3 The customer must provide access to a 240-volt mains power socket within the designated space for the photobooth.
7.4 The customer must also provide access to the venue at least 1 hour prior to the scheduled start time to allow for setup.
7.5 If the venue or event is located outdoors, there must be adequate cover from rain and other adverse weather conditions.
7.6 Additionally, there should be a clear and unobstructed path into the venue or event location.


8. VIDEO CAPTURING, SHARING & SOCIAL MEDIA 

8.1 By utilising the Photobooth, both you and your guests are consenting to the recording of your video or photo.
8.2 It is the responsibility of adults, parents, or guardians to supervise their children at all times. By allowing your child to enter or use the Booth, we interpret this as granting permission for their video to be taken. If an adult, parent, or guardian does not wish for their child's video to be shared on the online gallery or used on social media, they must inform a 360 Family attendant immediately. Alternatively, they can contact us via email at info@the360family.co.uk after the event to request the removal of any video content.
8.3 Any video or photo content captured during your event is yours and your guests' to keep, share, and use as desired.
8.4 Once a photo or video is captured, we provide the content to you through a QR code, Airdrop (for iOS devices), email, or WhatsApp.
8.5 All photo and video content is automatically stored in an online gallery. Following your event, we will send you the online gallery containing all the captured video content.
8.6 For efficient and prompt sharing, a Wi-Fi connection is required. We recommend a minimum upload speed of 7 Mbps (megabits per second) or higher. Sharing may be delayed if you have a slow upload speed.
8.7 The 360 Family reserves the right to utilise any video content captured at your event on our social media channels and/or website. It is your responsibility to inform your guests that their video content may be used on social media. If you do not wish for your or your guests' content to be used, please contact us directly via email at Info@the360family.co.uk.


9. DELAYS/LATE STARTS 

9.1 In the event that your event is delayed or if the requirements stated in clauses 2 and 6 are not met, or if incorrect information has been provided, we will proceed with your booking once the issue(s) have been resolved. However, no additional time will be added, and your booking will still end at the original scheduled time.
9.2 In the case of any unforeseen circumstances where The 360 Family Team is late or delayed in setting up and starting your session, we will compensate for the lost time by adding it to the end of your booking. Rest assured that you will not lose any of the time that you have paid for.


10. AGE RESTRICTIONS 

10.1 To utilise the photo booth without supervision, individuals must be at least 10 years old.
10.2 For children under the age of 10, it is mandatory to have an adult present with them at all times while using the booth. The parents or guardians hold complete responsibility and legal liability for their safety.
10.3 Children are strictly prohibited from entering the cordoned area (the designated space for the 360 marked by barriers or an inflatable booth) without supervision at any given moment.

11. BEHAVIOUR AND MISUSE  

11.1 The use of the photobooth is strictly prohibited for individuals who are heavily intoxicated with alcohol. If any member of the 360 Team believes that any guests or customers are excessively intoxicated, they have the sole discretion to deny entry to the booth.
11.2 Under no circumstances are individuals under the influence of drugs allowed to use the photo booth.
11.3 It is strictly forbidden to jump on or off the booth's platform while it is in operation, as this can cause harm to personnel and/or damage to the Photo Booth.
11.4 Once the 360 booth starts, it is important not to grab or touch the moving 360 stick, as this can cause significant damage to the motor.
11.5 We have a zero-tolerance policy for any form of abuse or threatening behavior towards our team members or misuse of our equipment. In such cases, we reserve the right to immediately terminate our services.


12. DAMAGE TO EQUIPMENT  

12.1 You are accountable for any expenses incurred due to damage or theft caused by you or your guests to the Photobooth and/or our equipment.
12.2 The damages or theft will be recorded, and you will be informed about the cost required for repair or replacement. An invoice will be sent to you via email, and it must be paid in full within 14 days before the specified payment date.
12.3 If the invoice is not paid in full, legal measures will be taken.


13. RISKS / INJURY  

13.1 Our Team is dedicated to prioritising your safety while using the Photobooth, which is considered a low-risk item. We assure you that every effort will be made to ensure your well-being. However, it is important to note that by choosing to use the Photobooth, both you and your guests assume the associated risks, thereby releasing The 360 Family from any liability.
13.2 The 360 Family cannot be held accountable for any injuries, fatalities, or property damage that may occur as a result of using any item provided. Regardless of the circumstances, we will not be liable in such cases.
13.3 By accepting our terms and conditions, you acknowledge and accept full responsibility for using the Photo Booth in a safe manner, both for yourself and your guests.


14. THE 360 FAMILY BOOTH ATTENDANTS

14.1 The setup and packing of all equipment will be handled by The 360 Family Team.
14.2 If you have any enquiries on the day, our staff will be available to provide guidance and assistance.
14.3 We kindly request that guests and event attendees cooperate with our staff to ensure a safe working environment. It is expected that our staff be treated with respect at all times.
14.4 Any behaviour that may compromise the safety or well-being of our staff, such as harassment, disrespect, aggression, physical acts, or threats, will not be tolerated. In such circumstances, we reserve the right to immediately cease services without providing refunds. The decision to do so rests solely with the members of The 360 Family Team operating the event.
14.5 The operation of The 360 Photobooth must be carried out by a team member at all times.
14.6 For bookings lasting between 4 to 5 hours, our staff is entitled to a brief 15-minute break to use restroom facilities and have a refreshment. During this time, the Photobooth will be temporarily closed.
14.7 For bookings lasting 6 hours or longer, our staff is entitled to a 30-minute break to use restroom facilities, have food, and refreshments. During this time, the Photobooth will be temporarily closed.


15. AGREEMENT  

15.1 The ownership of the hired items will always remain with The 360 Family (The Owner).
15.2 The term "items" refers to all props that are rented from the owner to the hirer.
15.3 The Hirer is the individual(s) mentioned on the invoice agreement.
15.4 You have informed your guests/relevant individuals about this information, and they acknowledge and agree to the Terms & Conditions.
15.5 By making the deposit payment, you confirm that you have read this document and fully accept all the specified terms and conditions.
15.6 By signing the event contract agreement, you confirm that you have read this document and fully accept all the specified terms and conditions.

These terms and conditions govern your use of our website.

1. SITE ACCESS 

1.1 You will be able to access the majority of this Website without having to register any details with us.  
 

2. USE OF WEBSITE 

2.1 You are permitted to use our website for your own purposes and to print and download material from this Website provided that you do not modify any content without our consent. Material on this website must not be republished online or offline without our permission.  

2.2 The copyright and other intellectual property rights in all material on this website are owned by us or our licensors and must not be reproduced without our prior consent. 

2.3 Subject to paragraph 2.1, no part of this Website may be reproduced without our prior written permission. 
 

3. SITE UP TIME 

3.1 We take all reasonable steps to ensure that this Website is available 24 hours every day, 365 days per year. However, websites do sometimes encounter downtime due to server and, other technical issues. Therefore we will not be liable if this website is unavailable at any time. 

3.2 This Website may be temporarily unavailable due to issues such as system failure, maintenance or repair or for reasons beyond our control. Where possible we will try to give our visitors advance warning of maintenance issues but shall not be obliged to do so. 


4. VISITOR CONDUCT 

4.1 With the exception of personally identifiable information, the use of which is covered under our Privacy Policy, any material you send or post to this Website shall be considered non-proprietary and not confidential. Unless you advise to the contrary we will be free to copy, disclose, distribute, incorporate and otherwise use such material for any and all purposes. 

4.2 When using this website you shall not post or send to or from this Website any material: (a) for which you have not obtained all necessary consents; (b) that is discriminatory, obscene, pornographic, defamatory, liable to incite racial hatred, in breach of confidentiality or privacy, which may cause annoyance or inconvenience to others, which encourages or constitutes conduct that would be deemed a criminal offence, give rise to a civil liability, or otherwise is contrary to the law in the United Kingdom; (c) which is harmful in nature including, and without limitation, computer viruses, Trojan horses, corrupted data, or other potentially harmful software or data. 

4.3 We will fully co-operate with any law enforcement authorities or court order requiring us to disclose the identity or other details of any person posting material to this website in breach of Paragraph 4.2.

7.2 Nothing in these Terms shall exclude or limit liability for (i) death or personal injury caused by negligence (as defined by the Unfair Contract Terms Act 1977); (ii) fraud; (iii) misrepresentation as to a fundamental matter; or (iv) any liability which cannot be excluded or limited under the law of the United Kingdom. 


8. GOVERNING JURISDICTION 

8.1 This Legal Notice shall be governed by and construed in accordance with English law. Any dispute(s) arising in connection with this Legal Notice are subject to the exclusive jurisdiction of England and Wales.
